HOA Rules & Regulations*
ARCHITECTURAL RULES AND REGULATIONS
Building Limitations. Only one single-family residential Structure shall be constructed on each Lot, and no other Structures shall be constructed on a Lot without the prior written approval of the Board of Directors. No mobile homes shall be constructed or located on any Lot. No Structures of a temporary nature, including, but not limited to, storage sheds, trailers, tents, shacks, barns, or other such structures, shall be constructed or installed on a Lot without the prior written approval of the Board of Directors, provided, however, that temporary structures reasonably necessary to the construction of approved Improvements or Structures shall be permitted during such construction.

Building Site Approval. The location of any Improvements or Structures to be constructed on a Lot shall be subject to the approval of the Declarant or the Board of Directors in accordance with the procedures set forth in Section 9.01.

Building Dimensions. The residential structure constructed on a Lot shall have a minimum of 500 square feet of living area (which area shall not include garages, porches, patios, terraces, decks, unfinished basement areas, or similar areas even if these areas are integral parts of the residential Structure).

Building Foundations. The foundation for any Structure on a Lot shall be constructed of poured concrete, provided, however, that the Board of Directors may permit the use of alternative materials that adequately meet objectives established for the Property’s aesthetic quality. The use of concrete masonry units shall not be permitted for the construction of foundations for Structures.
Building Materials. Structures shall be constructed of wood, brick, masonry, stone, or fiber cement siding, provided, however, that the Board of Directors may permit the use of alternative materials that adequately meet objectives established for the Property’s aesthetic quality. Vinyl siding shall not be permitted for the construction of Structures.

Underground Utilities. Any and all pipes, lines, and wires used for the transmission of water, fuel, storm drainage, natural gas, electricity, telephone, security, telecommunication systems, television, sewage, or any other utilities that are not within a building shall be constructed and maintained underground within the Lots unless required to be above ground for technical or environmental reasons and approved by the Board of Directors. Temporary above-ground utilities may be approved by the Board of Directors for use during construction until permanent underground service is available to the Lot on written advance approval by the Board of Directors.

Septic Drainage Systems. Each Owner shall be responsible for installing any sewage treatment or disposal system, including any septic tank and drainage fields, for any Structures in compliance with any applicable regulations or requirements.

No Fences. No fences shall be constructed or permitted to remain upon any Lot, provided, however, that the Board of Directors may permit the use of fences around cliff areas where safety is a concern, that adequately meets objectives established for the Property’s aesthetic quality.

Swimming Pools. All swimming pools shall be in-ground pools. Above-ground pools shall not be permitted to be installed upon or to remain upon any Lot.

No Detached Garages. No detached garages shall be constructed or permitted to remain upon any Lot.
Parking. Each Owner must provide on its Lot adequate parking areas for the use of its Lot. No parking shall be permitted on any of the roads that are part of the
Common Areas. To the extent required by the Board of Directors, all parking areas shall be screened to reduce the visibility of automobiles and parking areas from the Common Areas, in a manner satisfactory to the Board of Directors.

Screening. All antennae, satellite receiving and transmitting equipment, roof-mounted equipment, other equipment, and outside storage areas on the Lots, and such other items and areas as may be designated by the Board of Directors, shall be screened in a manner satisfactory to the Board of Directors. The Board of Directors shall have the full power to determine what facilities or areas must be screened and the requirements for screening.

Signage. No sign of any nature, including flags, shall be placed on the Lots except as approved by the Board of Directors. The Declarant or the Association shall have the right to install and maintain signage on the Common Areas.
Tree Removal. No tree over four (4) inches in diameter at breast height may be removed from any Lot without the prior written approval of the Board of Directors, provided, however, that the Board of Directors’ approval of plans and specifications for the construction of Improvements or Structures on a Lot shall be deemed to authorize the removal of trees as necessary to construct the approved Improvements or Structures.

Property Names and Signs. Each Owner may submit for approval to the Board of Directors a name for their Property. After approval, the name will be placed at the entry to the driveway on the railroad tie with the street address. The sign will be similar in design to other Member Structures and paid for by the Association.
PROPERTY RULES AND REGULATIONS

It is the intent. purpose and desire of Sky Ridge Retreats, a Kentucky nonprofit corporation, (the “Association"), to be of the highest possible quality and a credit to the community of which it is a part as well as a source of pride for its residents. To ensure that this objective is obtained, the development of the project and completion of the residence has been and will be done in a manner so as to minimize disturbance to the natural environment. The development is bordered by undisturbed National Forest therefore lot owners must take special care to ensure the beauty of the area and be respectful of what the National Forest Service is preserving around the property. Accordingly, the intent and purpose of the restrictions of this development are to enhance the objective of high-quality housing in a natural setting.

The following rules shall apply to all of the Property:

Hunting or discharging any kind of firearm (including “B-B” guns, pellet guns, and bows) is prohibited. The Forest Service allows the public to hike and climb in the valley below the cliffs. Therefore, the shooting of any firearms is extremely dangerous and is strictly prohibited.

Discharging or using any kind of fireworks or other pyrotechnic device. Because of the high risk of fire danger, all fireworks are prohibited regardless of wet/dry weather conditions.

Small wood fires for warmth or cooking, when allowed by the state of KY (not during fire emergencies or during fire season), are only allowed in designated areas (in a fire pit) and must be monitored at all times. The property is subject to KRS 149.400 ;

During fire seasons, it is illegal to burn anything within 150 feet of any woodland or brushland between the hours of 6 a.m. to 6 p.m. Spring Forest Fire Hazard Season: Feb. 15 - April 30. Fall Forest Fire Hazard Season: Oct. 1 - Dec. 15.

The racing of any motorized vehicle is prohibited.

Quiet hours will be observed from 10 p.m. to 8 a.m. daily. No construction is to start before 8 a.m.

No large trucks or commercial vehicles shall be parked or allowed to remain within the development other than while engaged in the delivery of materials during the periods of construction.

No motor vehicles shall be allowed to park upon the right-of-way of any street within the development in such a manner as to obstruct the reasonable flow of traffic or in any manner as to materially affect any adjacent property.

No inoperable vehicles are stored for longer than 3 weeks.

Owners shall be held responsible for all of the actions of their invitees and guests including the children of the Owners and the children of their invitees and guests.
The following rules shall apply to the Association’s Common Areas:

Smoking is prohibited.
-
Walk/Hike/Play at your own risk. Some areas may be close to cliffs or other natural features which may be dangerous.

Group use for weddings or other functions may be allowed with prior approval from the Board of Directors.
-
Leaving refuse, litter, or debris anywhere is prohibited.
-
Cutting or damaging any timber, tree, or other forest product is prohibited.
-
All children under the age of 12 must be supervised by an adult.
-
Storage is prohibited.
-
Camping is prohibited.
The following rules shall apply to the use of any of the Association’s hiking trails:

Hike at your own risk. Some hiking trails may be close to cliff lines or other natural features, which may be dangerous.

Use of the Association’s hiking trails is subject to KRS 411.190, and the Association assumes no duty or responsibility to keep the trails safe for use by others or to give any warning of any dangerous condition, use, structure, or activity on or associated with the use of the trails to persons entering upon the Association’s property for use of the trails.

The following are prohibited:

Using a trail after dark;
-
Operating any form of wheeled vehicle, including skateboards, bicycles, or motorized all-terrain vehicles on a trail;
-
Allowing dogs or any other animal to remain unleashed or unrestrained on a trail;
-
Traveling by or leading a horse, pack animal, or other livestock;
-
Building, maintaining, attending, or using a fire on or around a trail;
-
No hiking under the influence of mind-altering substances.
The following shall apply to the use of Both Ponds of the Association:

Pets are not allowed in the water.
-
Only non-motorized boats are allowed on the pond and only from 8:00 a.m. until dusk.
-
No glass containers are allowed anywhere around the pond.
The following shall apply to the use of the Association’s Swimming Water:

Swimming hours are from 8:00 a.m. until dusk.
-
Swimming is allowed but no lifeguard is on duty – do so at your own risk.
-
Children under 12 must wear a life jacket.
-
Skinny dipping is prohibited.
-
Fishing is prohibited.
-
No swimming under the influence of mind-altering substances.
-
Never swim alone.
-
No diving.
The following shall apply to the use of the Association’s Fishing Pond:​

Swimming is prohibited.
-
Catch and release is required.
